A new video obtained by Rolling Stone has called into question the claim of controversial rapper DaBaby that he acted in self-defense when he shot and killed a teenager in 2018.

The artist – whose real name is Jonathan Kirk – was involved in a deadly quarrel that led to the death of 19-year-old Jaylin Craig. However, the charges against Kirk were dismissed in March 2019 after a key witness failed to appear in court.

On Sunday, Rolling Stone released an unreleased video of the incident that occurred on November 5, 2018 at Walmart in North Carolina.

In the video, Jonathan “DaBaby” Kirk, along with teenagers Henry Douglas and Craig, are seen fighting. Kirk seems to have started the quarrel by attacking Douglas.

At one point, Craig is seen standing aside as Kirk attacks Douglas, hits him, and hits him.

Craig then appears to be pulling out a gun, although it is unclear if he is retrieving it. Kirk was then seen pulling out his pistol and firing several shots.

Kirk’s version of events paints a different picture of the incident. He said in a video on social media in 2018 that he was facing people with weapons that could harm him, his daughter and his son.

“The daughter could be hit, the son could be hit [and] me, “DaBaby said.” Damn lawyers who tell me not to say anything and damn it. Two n —– come down on you and your whole fucking family, threaten you all, beat you, n —-, let me see what you do. ”

Rolling Stone spoke with Todd Owens, a defense attorney and former North Carolina District Court judge, who said what was seen in the video weakened Kirk’s claim that he was in danger.

“Getting up and pushing someone who is brandishing a firearm or seeing a firearm is a really, really risky business,” Owens said. “This completely undermines this legal theory.”

Legal analyst Emily Baker told Rolling Stone that the situation may not be so clear because witnesses say they saw Craig with a gun, although Kirk appears to have started the battle.

“It’s not. ‘These people came after me and tried to roll me, and I had to defend myself,’ Baker told Rolling Stone. “That’s not what this video shows. This video shows a battle that got out of hand very quickly and that led to someone’s death.”

Rolling Stone also issued a statement from a representative of the district attorney’s office stating that it had “reviewed the police investigation file” and agreed with police not to charge Mr Kirk further. This is due to the fact that the prosecutors could not prove beyond a reasonable doubt that the defendant did not act in self-defense. ”

Representatives of the rapper did not immediately respond to a request for comment from Insider.

Earlier this month, Kirk was involved in another shooting incident, this time with a man he shot in front of his home.
