A Penticton man has filed a lawsuit against Wow Golf Club Inc., claiming he was seriously injured after the brake on one of the golf carts on the course failed.

In a lawsuit filed on May 3, 2022 in Penticton, David Turner claims that on or about May 16, 2020, he was driving a golf cart down a hill when the car’s brakes failed, causing the cart to hit embank and roll over and throw it away.

The lawsuit alleges negligence that the golf course “did not take any care … to ensure that the plaintiff would be reasonably safe when visiting the premises”, together with the failure to inspect the golf carts and in turn to hire on the cartridges of golf carts Wow Golf Club with defective equipment.

The lawsuit also alleges that Turner suffered multiple injuries, including multiple fractures, lacerations and collapsed lungs. Turner claims that he continues to suffer “pain, suffering, loss of enjoyment of life, loss of income and permanent disability.”

The lawsuit does not specify a dollar figure, but seeks total damages for pain and suffering, lost income and missed income opportunities, future care costs, loss of household capacity, among others.

Castanet’s attempts to reach Wow Golf Club for comment were unsuccessful.
