An Ottawa judge has ruled that Freedom Convoy organizer Tamara Leach will remain on bail pending trial.
Ontario Supreme Court Justice Judge Kevin Phillips said his decision was based on how well Leach’s bail had controlled her, that she had complied with her bail conditions, along with “tastes like prison,” which reduces the risk of recidivism.
The judge said he did not accept that Leach had violated his release by agreeing to receive a reward, adding that Leach could be trusted to comply with his release.
She was released on a long list of conditions, including a ban on all social media and an order to “not support anything related to the convoy of freedom.”
The conditions for Leach’s release were aimed at preventing such a protest in the national capital, the judge said, adding that the court did not seek to control people’s political views.
“The courts are not mental police. “We only seek to control behavior to the extent that certain behavior will violate or is likely to violate the law,” he said.
The protest ended and he left Ottawa, he said, adding that it would be “practically impossible” to hold such a protest in the city again.
Moiz Karimji, the crown prosecutor, said last week that Leach had violated one of his bail conditions by agreeing to accept a reward for leadership during the Ottawa protest and must be returned to jail to wait. process.
Leach and his fellow protest leader Chris Barber have been jointly charged with mischief, obstructing police, advising others to commit mischief and intimidation.
Leach’s lawyer, Lawrence Greenspon, said last week that bail conditions should be eased to allow her to come to Ontario and use social media.
