GOP lawmakers could step in to protect North Carolina voters’ identity law, Supreme Court ruling
Two Republican leaders in the North Carolina legislature could step in to protect the voter identity law, even though the state’s attorney general, a Democrat, is already doing so, the Supreme Court said.
The opinion will make it easier for other government officials to intervene in some cases in cases where the state government is divided.
Supreme Court facilitates death row inmates to challenge execution method
The Supreme Court has ruled in favor of a death row inmate in Georgia who is challenging the state’s lethal injection protocol and is seeking death by firing squad, a method not currently permitted in the state.
The court said a prisoner could take a challenge under a federal civil rights law that allows people to seek redress when their constitutional rights are violated. The decision could make it easier for prisoners to challenge their potential method of execution.
The Supreme Court restricts the possibility of exercising Miranda’s rights
The court limited the possibility of imposing Miranda’s rights in a ruling that suspects who have not been warned about their right to remain silent cannot prosecute a police officer for damages under federal civil rights law, even if the evidence was ultimately used against them in their criminal proceedings. .
The decision will reduce the person’s protection against self-blame by banning the possibility of receiving compensation. This also means that the lack of administration of the warning will not expose a law enforcement officer to potential damages in a civil case. However, this will not affect the exclusion of such evidence in criminal proceedings.
The court clarified that while Miranda’s warning protects a constitutional right, the warning itself is not a right that would trigger the possibility of civil proceedings.
