Judges from the US Supreme Court are preparing to meet for a conference day tomorrow as they deal with the aftermath of an expired draft opinion that, if released, will overturn Rowe v. Wade.
Since the project went public, abortion rights activists have been protesting not only in front of the Supreme Court building, but also outside the private homes of conservative judges. Meanwhile, Chief Justice John Roberts called for an investigation into how the document leaked in the first place.

“This is the most serious attack on the court, perhaps from within, that the Supreme Court has ever experienced,” a source described as “close to the court’s conservatives” told Politico. “It’s an understatement to say that they are very, very burdened by this.”
Thursday’s conference is the first since Politico published an expired opinion. Since then, protesters have stood in front of the homes of Republican-appointed judges, and the Supreme Court has erected a fence around the courthouse. A left-wing group called Ruth sent us, planning protests in front of the homes of six conservative judges on Wednesday.

The White House, meanwhile, endorsed the move, with White House spokeswoman Jen Psaki saying “so far they have been peaceful.” This is despite a federal law that prohibits “picketing or parading” outside the judge’s residence “with the intention of influencing them.”
So far, Politico reported, the expired project by Judge Samuel Alito, which is dated February, is the only project circulated internally so far. No special opinions have been disseminated yet.

A statement from the Supreme Court last week said that although the expired document was “authentic”, it “does not constitute a court decision or the final position of any member of the case”.
