Prosecutors have charged with murder in a mass shooting that shook the California capital a month ago.

District Attorney Anne Marie Schubert said Tuesday that Smiley Martin, Dandrae Martin and Mtula Peyton have been charged with murder in the killings. All three qualify for the death penalty if this decision has not yet been made.

A gang feud erupted in a shootout before dawn on April 3, when visitors to bars and nightclubs took to the streets of downtown Sacramento. Six people were killed in the bloodshed, including a man who is an alleged shooter.

A dozen others were wounded by bullets, including two other alleged gunmen. Police say at least five people fired bullets during the shooting.

Court documents describe Smiley Martin as a dangerous, unrepentant member of a gang with a “lifelong commitment to violence.” Police say his brother Dandrae Martin also fired a gun during the melee.

Police have identified only four of the suspected gunmen: brothers Martin, Mtula Peyton and Devasia Turner.

Turner, 29, was killed in the shooting. Both Martin brothers are in prison. Police do not know where 27-year-old Peyton is. The Martin brothers are scheduled to return to court on May 27, records show.

The brothers’ lawyers have not yet commented publicly on the case.

In addition to Turner, others killed in the shooting include Sergio Harris, Joshua Hoye-Luquezi, Jontaya Alexander, Yamile Martinez-Andrade and Melinda Davis.

Authorities say Harris and Hoye-Lucchezi were also involved in the dispute with the Martin, Turner and Peyton families.
