The court blocked Biden from lifting the border restrictions under Title 42 on May 23

A Louisiana federal court issued a temporary restraining order Monday, preventing the Biden administration from lifting pandemic restrictions on the southern border.

Restrictions known as Title 42 allow the authorities to expel almost all migrants from the border in order to stop the spread of COVID-19. The states of Missouri, Arizona and Louisiana filed a lawsuit earlier this month in federal court to maintain the restrictions.

“Our service has just received a temporary restraining order to keep Title 42 in force,” Missouri Attorney General Eric Schmidt tweeted Monday. “It’s a huge victory for border security, but the struggle continues.”

The Centers for Disease Control announced on April 1 that they had determined “[suspension of] the right to bring migrants into the United States is no longer necessary, “he said, adding that the restrictions would be lifted on May 23.

Fox News reported on Monday that the restraining order prevented any action before the May 13 hearing scheduled for the case. Neither the CDC nor the Biden administration have proposed lifting the restrictions before May 23.

“Congress will have to take action to avoid the date of May 23,” White House spokeswoman Jen Psaki said Monday, asking about the administration’s plans to lift the restrictions.

The decision to end power under Title 42, named after the Public Health Act of 1944, is being challenged under a 22-state law and is facing growing divisions in Biden’s Democratic Party.

Representative Henry Cuelar, a Texas Border Democrat, said last week that Biden was hurting their party by ending Title 42.

“This is not good for Democrats in November. You know, in a conversation with some of my Republican colleagues, they say, “We can’t believe the White House is giving us this story. “We can’t believe they’re hurting Democrat candidates in the November election,” the congressman told Fox News Digital on Thursday.

“And you know that, look at the polls. Republican voters are not happy with what is happening at the border. Democrat voters are not happy. And if you look at the independent voters, they are not happy with this decision. So who are we trying to please? ”

In addition, other Democrats, including Sen. Mark Kelly of Arizona, Maggie Hassan of New Hampshire, Chris Koons of Delaware and Gary Peters of Michigan, have asked the administration to reconsider the repeal of Title 42.
