MLA Thomas Dang is facing charges under the Health Information Act

An Edmonton MLA who admitted to using the prime minister’s date of birth to “hack” Alberta’s COVID-19 recording system has been charged under the province’s Health Information Act.

Thomas Dang, who represents Edmonton-South, resigned from the NDP group in December when the RCMP first announced the investigation.

Dang faces a non-criminal charge of “illegally attempting to access personal information contained in the Alberta Health Vaccine Portal,” RCMP spokesman Fraser Logan said in a press release.

Dang, 27, received a subpoena and is due to appear in Edmonton County Court on July 27.

“If convicted, a person who violates this section could be fined up to $ 200,000 under the law,” Logan wrote.

“(Dang) has been informed through his lawyer that no criminal charges will be filed and is looking forward to a final settlement of the matter. He has no further comment until the scheduled hearing, “Dang spokeswoman Leah Ward told CTV News Edmonton after the indictment was announced.

Last Friday, Dang asked to rejoin the NDP and said he had been working with the RCMP and crown prosecutors “for months”. He said he expected an “administrative fine”.

Dang said he was trying to show “vulnerabilities” on the province’s website and said he “immediately” notified Alberta Health when he found out there was a problem.

NDP leader Rachel Notley reiterated on Friday that Dang’s request to rejoin the party was still being considered.
