But Lee was charged with four counts, including battery and gun possession, Los Angeles City Attorney Mike Foyer said in a press release and video message posted on Twitter Thursday afternoon.
Prosecution spokesman Greg Riesling said in a statement to CNN: “After reviewing the evidence, prosecutors found that while there was criminal conduct, the evidence presented did not constitute criminal conduct.
According to LA County records, Lee remains in police custody.
Los Angeles police spokeswoman Lizette Lomelli told CNN on Wednesday that Chappelle had “finished his act and while leaving the stage, a man who was part of the audience jumped on stage and brought the celebrity to the ground.”
Lee, 23, was arrested and taken to hospital for treatment, Lomelli said.
Police described the weapon, which they said was taken from the suspect, as a replica of a pistol that included a knife blade.
The motive for the apparent attack remains unclear.
A Chappelle spokesman issued a statement Wednesday.
“As pitiful and disturbing as the incident was, Chapel continued with the show,” said Carla Sims, a spokeswoman for Chappelle, in a statement to CNN. “Jamie Foxx and Chris Rock helped calm the crowd with humor before Chappelle introduced the latter and introduced musical guests for the evening.”
Sims said Chappelle was “fully cooperating” with the police investigation into the incident.
Chappelle participated in the Bowl in “Netflix is a Joke: The Festival”.
“We care deeply about the safety of the creators and strongly support the right of stand-up comedians to perform on stage without fear of violence,” a Netflix spokesman said in a statement to CNN on Wednesday.
