President Biden’s administration will comply with an upcoming order from a Louisiana federal judge, which is expected to block the lifting of restrictions on COVID-19 borders.
The restrictions, known as Title 42, are a health measure from the Trump era that has been used to deport more than 1 million migrants. The Biden administration had previously planned to end Title 42 on May 23, a move that would increase illegal immigration.

A Louisiana District Court judge announced plans to block such a move until Biden negotiated a deal with the Republican border states. A senior administration official said the White House planned to carry out the order on Tuesday, according to Politico.
“If and when the court issues a TRO [temporary restraining order] the department plans to comply with this order, “the official said, continuing to complain about the decision.” It really doesn’t make sense for us plaintiffs to demand that the court order that [Department of Homeland Security] to be stopped from its use for expedited removal, which will prevent us from adequately preparing for aggressive applications for immigration legislation when public health expires. “
On Tuesday, the Department of Homeland Security (DHS) released a plan on how to tackle migration spikes after Title 42.

The plan will increase resources for medical care and transportation at the border, but does not differ significantly from what DHS published when it first announced plans to end Title 42 on April 1.

However, both Republican and Democratic members of Congress expressed concern about the plan earlier in April. Arizona Democratic Sen. Mark Kelly said on April 16 that DHS’s plan was inadequate.
“The administration hasn’t even prepared and they don’t have a plan for what to expect. Forget about the unexpected part, I’m just asking for the first part of it,” Kelly told Fox News Digital at the time. “We know what the situation will be on the ground. Let’s come up with a detailed plan and implement it – and I just haven’t seen that.”

The Biden administration says it is preparing to handle up to 18,000 migrants a day in the event of the end of Title 42. 210,000 border attempts were made in March, and those numbers are expected to rise in the coming weeks and months.
