Draft Supreme Court Opinion to annul Rowe v. Wade, published by Politico

The project was released in early February, according to Politico. The final opinion has not been published and the votes and language may be changed before the opinions are officially published. The opinion on this case is expected to be published only at the end of June.

CNN has not independently confirmed the authenticity of the document. Politico says it has certified the draft. A Supreme Court spokesman declined to comment to CNN.

According to the bill, the court will revoke Rowe’s possession of Wade’s federal constitutional right to abortion. The opinion would be the most consistent solution to abortion in decades and will transform the landscape of women’s reproductive health in America.

Politico’s publication of the draft is unprecedented by the Supreme Court’s standards of secrecy. Internal discussions between judges while drafting opinions and arranging votes are among the strictest details in Washington.

The case in question is Dobbs v. Jackson. It is a challenge to the Mississippi’s 15-week ban on abortion, and oral arguments were heard on December 1. A final opinion on the case is expected later this spring or early summer.

In the draft opinion, Alito wrote that Roe “should be repealed”.

“The constitution does not mention abortion, and no such right is implicitly protected by a constitutional provision,” Alito wrote. He said Rowe was “extremely wrong from the start” and that his motives were “extremely weak and the decision had harmful consequences”.

He added: “It is time to listen to the constitution and return the issue of abortions to MPs.”

“This is required by the Constitution and the rule of law,” he said, according to the draft.

Nearly half of the states already have or will pass laws banning abortion, while others have introduced strict measures to regulate the procedure.
