Giuliani discusses Pence’s ability to cancel votes: former Trump lawyer

Eric Hershman, a former lawyer in Trump’s White House, revealed on Thursday that even in the morning of the Capitol riot, Rudy Giuliani was still debating whether then-Vice President Mike Pence had the power to cancel the vote in the 2020 election.

Hershman’s testimony was released Thursday during the third of six public hearings organized by the Jan. 6 commission investigating the Capitol riot. Thursday’s session focused on pressure from Trump’s camp in an attempt to get Pence to cancel the vote.

Hershman said he received a “surprise” call from Giuliani on the morning of January 6, 2021, about Pence’s role that day.

“And, you know, he asked me about my views and analysis, and then the practical implications of that,” said Hershman, who described the conversation as an “intellectual discussion.” “And when we were done, he said, ‘I believe you know, you’re probably right.'”

Representative Pete Aguilar, a member of the House committee, said this was indicative of how Giuliani was aware of the problem with advertising the theory that Pence had managed to cancel the vote.

“Of course, the fact that Mayor Giuliani seems to have admitted that the theory is wrong did not stop him from appearing in front of the crowd just hours later on January 6 and saying the exact opposite,” Aguilar said, referring to Trump’s ally. lawyer and former mayor of New York.

He then released a clip of Giuliani’s speech at Trump’s rally on Ellipse, which preceded the Capitol riot. In the video, Giuliani was heard claiming that Pence could “decide on the validity of these crooked ballots or send them back to the legislature, giving them five to 10 days to finally complete the work.”

Giuliani has continued to make false allegations of voter fraud in the 2020 election. He is also facing a $ 1.3 billion defamation lawsuit against him, his Trump ally Sidney Powell and MyPillow CEO Mike Lindell of Dominion Voting Systems.

Giuliani was also removed from law practice in New York and charged with an ethical charge by the DC Bar for his baseless allegations of the June 2021 election.
