Juul may continue to sell e-cigarettes after an appeals court suspended the FDA’s ban

Juul may continue to sell its e-cigarettes, although the Food and Drug Administration ordered a ban Thursday, according to the U.S. District Court of Appeals for the District of Columbia (via TechCrunch). In its order, the court said it was issuing a temporary stay to give Juul time to make an urgent proposal, which he could then consider along with a response from the FDA.

The FDA says the reason for the ban is that there is “insufficient evidence to assess the potential toxicological risks of using Juul products.” Juul filed a petition for permission to sell its vape products with tobacco and menthol flavors, but the FDA rejected the application. The regulator notes that it is illegal only to sell the device Juul and Juul pods, and not to own or use.

The court said that his order “should not be interpreted in any way as a decision on the merits [Juul’s] movement ”

According to the court order uploaded by Axios, Juul has until noon on the 27th to file his urgent request. According to the FDA’s website, the court says it does not allow Juul to sell its vaping products based on the validity of the company’s request – this decision will come later.

In his petition for the stay, which you can read in full below, Juul said he was facing “significant irreparable damage” if he was not allowed to sell his products while preparing his full offer of stay. “The FDA cannot reliably claim that there is a critical and urgent public interest in removing JLI products from the market right now, and not after this court has reviewed the FDA’s actions,” the company wrote.
