UPDATE, 10:28 a.m. PT: Amber Heard testified that fears for her own safety led her to file for divorce from Johnny Depp in 2016 and that she also sought a restraining order following a dispute in which he hit with the phone.
“I knew that if I didn’t, I probably wouldn’t literally survive,” Hurd said Monday as he struggled with tears. “I was so scared it was going to end really badly for me and I really didn’t want to leave it.”
She filed for divorce after a dispute on May 21, 2016 in their penthouse in downtown Los Angeles, which led to a police call. Although Hurd did not file a police report that evening, she later sought and received a restraining order against him.
“I wanted to change my locks, I wanted a good night’s sleep,” she said. “The guards would always let him into the house, no matter what I asked them.
She added: “I was scared and very controversial because the person I was afraid of was also the person I was in love with.
Depp denied Hurd’s allegations that he was physically abusive and filed a $ 50 million defamation lawsuit against her after she published a Washington Post article saying he was a “public figure representing domestic violence.”
In her testimony on Monday, she went through the events of May 21.
At the time, she and Depp had been separated for about a month. But his mother had just died, and he and I were making plans to visit the penthouse in Eastern Colombia that day.
Hurd said that when Depp arrived early that night, she could tell he was drunk. He started talking about an incident a month earlier in which feces were left on their bed. Hurd claims to be from one of their dogs, but Depp insisted that one of her friends left him there as a joke.
“He just kept going and kept going,” Hurd said.
She called a male friend on the phone to explain why such a joke was “impossible,” Hurd said, but Depp eventually yelled at him.
Hurd said that after Depp came out and climbed the stairs, he came back, grabbed the phone, and said to his friend, “You can take it. You can have it. ”
Then, she said, Depp “threw his hand away from the phone and threw it in my face.” She said she felt her eye was hit.
“I put my head in my hand and immediately started crying. I said, “Johnny, you hit me,” Hurd said.
She said Depp started making fun of her, saying, “Oh, yeah, I hit you, huh?”
She said he then “hit me on the head” and grabbed her by the hair.
“I don’t know if he intended to hit me in the face, but he makes this gesture around my face to try to expose my face to him,” she said. She said Depp then told her, “Let me see how badly I hurt you this time.”
Hurd said her friend Raquel, who lived in the apartment next door, entered the room and “managed to get in front, between him and me.” Hurd said she calmly told Depp, “No, Johnny, no.”
Her friend put her arms around her as she curled up around the couch, but “Johnny just yells at me to get up.”
She said two of Depp’s bodyguards then came in, and one of them told Depp, “Boss. boss. ” She said Depp then broke things around the apartment and eventually left.
Hurd said she did not call 911, but she did call her attorney, who referred her to a family lawyer. Depp’s lawyers objected to Hurd’s attempts to identify who called the police – a friend – but said that when police arrived, she told them she refused to cooperate on her lawyer’s advice.
She also refused to signal.
“I wanted to protect Johnny,” she said. “I did not want him arrested. I didn’t want him in trouble. I didn’t want the world to know. “
The jury was shown a series of photos showing redness on the side of his face. Hurd said the photos were taken that evening by her friend. Another photo she said was taken the next day showed a little blackness around the eye and redness underneath.
Depp admitted to throwing a phone on the couch, but denied hitting Hurd. His case focuses in part on witnesses who said they saw Hurd in the days after their dispute, but did not notice any bruises on her.
Hurd’s legal team also presented text messages that Depp wrote to Hurd on May 22, the day after the confrontation. “All my love and deep apologies,” he wrote that evening. Hurd said that in a telephone conversation with him, Depp “said he was sorry he reacted the way he reacted” and that “he is not a person to hurt me.”
PREVIOUSLY, 8:24 a.m. PT: Amber Heard’s testimony resumed Monday in a $ 50 million defamation lawsuit against her as the actress provided further details about her ex-husband’s alleged violence during the marriage them.
The Fairfax, Virginia trial was adjourned for a week as Judge Penny Azkarate attended a pre-scheduled court conference, but Hurd continued where she left off, with stories from their tumultuous marriage, accompanied by audio of their arguments and photos of her alleged injuries.
A photo from December 15, 2015, showed her bruised temple. Hurd testified that Depp caused the injury during one of their disputes.
“Johnny was holding a hand over part of my face, face down, and he was hitting my head, hitting me repeatedly on the head,” she said. “That’s the reason my temple is bruised.”
Depp denied abusing Hurd. He filed a lawsuit against her after she published a publication in the Washington Post in December 2018, in which she wrote that “two years ago I became a public figure representing domestic violence and felt the full force of our culture’s anger at women who talking”.
In testimony Monday, Hurd said Depp’s drug use had become so severe by January 2016 that he was “hallucinating.” Depp’s lawyer objected to this particular characteristic, but Hurd was allowed to describe other aspects of his behavior.
“He was talking to people who weren’t there, people who weren’t in the room,” she said. “He will comment on someone who is in the room behind me who is not there. It was horrible. “
Hurd also referred to a notorious incident in April 2016, when they quarreled after Depp missed dinner for his 30th birthday. She said their fight involved a fight, and Depp tossed a bottle of champagne that went through a painting. She said he then beat her on their bed and grabbed her by the pubis.
