A federal judge in New York on Wednesday rejected a recent attempt to use maps to redirect the area, which has already been declared unconstitutional, in favor of Democrats in the upcoming primary.
U.S. District Judge Lewis Kaplan declined to issue an emergency order Wednesday, seeking to prevent the state’s Supreme Court from imposing last week’s ruling that new congressional and U.S. Senate boundaries have been unconstitutionally changed and that Democrat-controlled legislation authority has not followed the correct card procedure.
“Let’s be honest. “This is Hail Mary’s omission, which aims to make a long attempt to conduct a primary state-run procedure, which the court says is unconstitutional,” Kaplan was quoted as saying by Fox 5 NY.

A 17-page complaint filed in Manhattan on Monday argued that there was not enough time to redraw the maps before the original date of June 28, and therefore existing maps needed to be restored to comply with the 2012 court order. A decade ago, another federal judge ruled that the primary date for a congress in New York in September was too late to ensure that ballots were received by foreign military voters before November.

Kaplan said on Wednesday that there would be “chaos” in forcing the primary elections to continue in June with the help of the unconstitutional map of the districts simply to comply with a 2012 decision by a different federal judge.
The primary election in Congress and the State Senate in New York was postponed to August 23 to allow time for Carnegie Mellon University independent scientist to draw replacement cards under the supervision of a state judge.
But the primary election for governor and state assembly will be held on June 28.

New York Gov. Katie Hochul, who originally signed the now-defunct cards, named US envoy Antonio Delgado, DNY, as her new candidate this year after her former vice governor, Brian Benjamin, was accused of federal bribery and corruption-related crimes.
“In the 102 years since my father, then a Ukrainian refugee, came to this country, if there were two things he was thinking about, they were: free, open, rational elections. [and] respect for the courts, “said Kaplan, a Democrat, on Wednesday, according to Politico.” The relief they are asking me to give today affects to some extent the public perception of both. “What should candidates do?” What should voters do? What should all people involved in elections do? “It is difficult for me to imagine a scenario that would cast a worse reputation on rationality, justice, consistency in the conduct of elections in this great country than on accelerating this,” Kaplan added, according to Fox 5.
“This is strongly against the public interest,” the judge said of the request. “And I simply reject the applications.”
