Jurors at the trial of Johnny Depp and Amber Heard expressed confusion on Tuesday about how they should have decided whether Hurd had slandered Depp.

The jury began a second day of deliberations on Tuesday, after six weeks of testifying in the defamation case.

Depp initially sued Hurd for $ 50 million, saying his ex-wife ruined his career by hinting in a 2018 Washington Post report that she was a victim of domestic violence. When Depp took a stand during the trial, he claimed that Hurd was the real bully in their relationship.

Hurd filed a $ 100 million counterclaim and spent several days at the booth, describing a number of incidents in which she said she was physically and sexually abused by Depp.

On Tuesday, the jury sent a question to the judge about the verdict list, which they were asked to fill out as they weighed over contentious lawsuits filed by Depp and Hurd.

Their question focused on the first of three statements in Hurd’s article for which Depp is suing her. The statement is the title of the article: “Amber Heard: I spoke out against sexual violence – and faced the wrath of our culture. That needs to change. ”

On the verdict list, the jury was asked if it thought the allegation was false, which is a key component in proving defamation. If they believe that the statement is true, it cannot be slanderous.

The jury was confused as to whether they were asked if only the title was fake or if the whole article was fake.

“Third question, is the statement incorrect, does it refer to the title or to the content of the statement, everything written in the letter?” The jury asked. Judge Penny Azkarate read the jury’s question to each country’s lawyers.

Azcarate told the jury that they should just judge if the title is fake, not if the whole article is fake.

Hurd is on trial for two more statements in the article, while Hurd’s counterclaim against Depp focuses on three statements Depp’s lawyer, Adam Waldman, told The Daily Mail in 2020, accusing Hurd of fabricating the allegations. for domestic violence.
