The second-degree murder sentence was overturned for the Leamington man

A second-degree murder sentence was overturned by the Ontario Court of Appeals due to an undeclared conflict of interest.

In 2012, 45-year-old Andrew Cowan drove a pickup truck in Leamington with his best friend, 53-year-old Edward Whit, in the passenger seat.

Cowen fled the road at high speed, shot the car in the air and crashed into the second floor of a building.

Whit died and the Crown claimed the crash was intentional.

The defense claims that Cowan and Whit entered into a suicide agreement

Cowan was sentenced and sentenced to life in prison.

On Wednesday, the Court of Appeals overturned the sentence, reopening a new trial.

The court ruled that there were legitimate concerns about bias, as the judge and the prosecutor were close friends.

Defense attorney Patrick Ducharme says his client has been denied a fair trial.
