What is the Law on the Influenced by Racketeering and Corrupt Organizations (RICO)?
The Law on the Influence of Racketeering and Corrupt Organizations, or RICO, was developed to fight organized crime. It was adopted in 1970 after it was signed by President Richard Nixon.
Federal, RICO was originally intended to be used to fight the mafia. It draws from a list of 27 federal crimes and eight state crimes committed repeatedly over a 10-year period. These crimes can include fraud, theft, computer crime, embezzlement, credit fraud, investment schemes, human trafficking, illegal gambling, bribery, kidnapping, murder, money laundering, counterfeiting and various drug charges.
The Ministry of Justice is using RICO to break up many criminal families and eradicate corruption in several city police departments. Prosecutors also used RICO to try to crack down on several street gangs and helped prosecute companies that violated federal law.
Georgia’s RICO statute is similar to the federal version, but much broader, as the criminal “enterprise” does not have to last that long. Georgia is one of only 33 states to have its own RICO status. However, in both state and federal law, a criminal enterprise model must be established.
