The defense attorney says the client was very worried after losing a family member.
Daniel Purvis will spend 60 days under house arrest for crimes against his relatives.
Sault Ste., 38. Marie Man pleaded guilty on Friday to two charges stemming from an incident in the Lower Island Lake on December 10, 2021.
He was charged with infiltration and entry for the purpose of committing a felony, but the Crown found him guilty of the felony for damages of less than $ 5,000.
He was also convicted of possession of stolen property for less than $ 5,000.
Ontario Judge Heather Mendes heard that Ontario police received a call about a man who approached a Brooks Road resident.
The man told the caller that his car was stuck on a nearby bridge and needed help to tow it.
The caller noted that Purvis Marine was on the side of the vehicle and officers learned that it had been reported stolen.
Police contacted the owner.
He has suggested that his cousin Daniel, who has had drug problems and problems with them in the past, may be involved, royal aide Blair Hagen told the court.
Officers traced fresh footprints in the snow from the scene to a camp owned by another cousin of the accused.
The glass on the main door was broken.
Purvis was arrested and taken to a hospital in the Salt area, where he was detained for mental health reasons.
Defense attorney Eric McQuey told the court that his client was in great pain after losing a family member.
He could not sleep and had “ideas” that he would “put an end to everything.”
Purvis did not comply, received medical treatment and was on medication.
McQuee said his client had found a job that was “grounding to him.”
“He was doing very well compared to that night,” when “he was in a state of mind in which he was unable to process what he was doing.”
He has “a lot of remorse,” the lawyer said, and understands what he has done and “tries differently.”
Due to his criminal record, a suspended sentence to be served in the community was recommended jointly by the Crown and the defense.
Purvis repents and his struggles with mental health problems have been taken into account, Hagen said.
“I’ve come a long way,” Purvis told the judge.
Mendes accepted the joint proposal, calling it both “appropriate and fair” and “short but sharp”.
During his suspended sentence, Purvis will have curfew from 9 pm to 7 am and will not be able to contact the applicants and will have to stay away from the camp.
He will be on probation for 12 months after serving his sentence.
