Pennsylvania Senate candidate David McCormick’s campaign is calling for additional ballots to be counted in the GOP primary, according to a lawsuit filed Monday.
The lawsuit insists on counting the ballot papers and the absence of missing date envelopes to be included in the election results.
“These ballots were undoubtedly submitted on time – they were stamped with the date of receipt – and there was no allegation of fraud or irregularity,” the Politico complaint said.
“The only basis on the boards of disenfranchisement of these voters is a technical error that is insignificant under both state and federal law,” he added.
Just last week, a federal 3rd district court of appeals ruled that undated ballots in last year’s district election should be counted, a ruling cited in McCormick’s appeal Monday.
The Hill turned to McCormick’s campaign for comment.
The pressure comes after last week’s election was declared too close to be announced, leading to a recount in the race between McCormick and Trump-approved famed doctor Mehmet Oz.

Pennsylvania law requires an automatic count if the candidates’ votes are within 0.5 percent, and Oz leads McCormick with less than 1,000 votes from Monday.
As a result of this recount, voters may have to wait until June 8 to learn the results of the election.
Trump, meanwhile, called on Oz to declare victory in the election, as votes are still being counted, saying it would make it much harder for them to cheat with the ballots they “just found”.
